Asked 2/13/2016 – Houston, TX
I was placed on probation for my 2nd DWI in Texas. I was ordered to get an interlock device which I did. This was in one county and I live and another so they transferred my probation to my county. I told my probation officer in both counties that I have an interlock device and neither knew anything about it. The probation officer in my county checked the reports and they stated that I had been driving because of the camera. I wasn’t pulled over or anything but my license is suspended so I shouldn’t be driving but I live here alone and have nobody to take me anywhere. She reported this to the county that placed me on probation. I have to go tomorrow with my lawyer to speak to a judge in reference to my occupational license which I’ve filed for so that I can drive legally.
Answer
Let me give you a taste of the questions you might be asked by your Judge:
“Sir, do you remember being placed on probation?”
“Did you receive a copy of the order granting probation?”
“Was one of the conditions of probation that you not violate any Municipal, State or Federal Law?”
“Is your driver’s license suspended?”
“Is it a violation of the law to operate a motor vehicle on a public street or highway when your license is suspended?”
“So you chose to violate the law AND my probation order instead of coming to me beforehand to obtain an occupational license?
Good Luck.
