Asked 2/20/2016 – San Antonio, TX

Background: I was involved in a very minor accident last month. There was no damage to my vehicle, the other driver admitted fault, and the responding officer also found the other driver at fault. The only the reason the police were called was because the other driver was in a company owned vehicle and wanted a paper trail just in case.

A few weeks later I needed a copy of the police report to give to my employer for background check reasons and quite a bit of the information on the police report was redacted. So much so that it is hard to tell who did what in the accident. I requested a full report or at least my name on the report revealed for clarification. The records clerk refused stating state law. The clerk wasn’t specific at all about what law prohibited the release of identifying information.

Answer

The police department has given you what they feel is required. to obtain a UN-redacted copy you will probably need a subpoena. Contact a local attorney who practices in the auto accident/personal injury area.
