Asked 2/22/2016 – Dallas, TX

Cops were called for a domestic dispute. No charges were made and no one went to jail. The police did however take photos and said something about handing them over for someone to look at.

Answer

Yes, it is possible that a case can be filed and charges can be pressed against someone, even if no one went to jail at the time of the event. The police can gather evidence, then turn the evidence to the District Attorney’s office. It would then be up to the DA’s office to determine if charges would be filed, and what the exact charges would be.
