I have a charge I am facing in Texas. The charge is Possession of a Controlled Substance. I was arrested and accused of possessing 3 ounces of marijuana but that is all, nothing about it was “controlled.” I have never been in trouble with the law before. This is my first offense, if convicted what prison in Texas will I be sent to? And if convicted what is the likely consequence going to be.
Answer
Possession of 3 ounces of marijuana in Texas is a misdemeanor, which at the worst would cause county jail time upon conviction. If a person is convicted of a felony and sentenced to time in the Texas Department of Corrections, the facility where that person would spend his confinement is totally up to the TDC, usually depending upon which facility has availability. You need to talk with a local attorney about your situation. From what you detail, your case is not heading in the direction you think it is.
