Asked 2/22/2016 – Sierra Blanca, TX

I was arrested months ago on a Bench Warrant from Texas. I live in California and I was arrested here. I was released from jail because texas didnt didnt extradite me. I dont believe my warrant shows up in California anymore because I have called my local sherrifs office and they said i dont have a warrant. But Texas is different than California. How long will i sit in jail in Texas (without posting bond) until my case is resolved or i am turned over to the DOC?

Answer

The statute of limitations is tolled for any case once the charging instrument is filed. The punishment range for your case depends on what you are charged with. The warrant will remain outstanding and the case will remain pending until you appear in court and resolve the matter(s). Contact an attorney in the county where your warrants are outstanding to see what can be done.
