Can the DPS still suspend a license, even though a new one was obtained after the arrest?

Asked 2/27/2017 – Austin, TX

Friend go arrested for a DWI in Texas (refused at time of arrest). After released from jail, his lawyer advised him to apply for a new driver’s license and he received it in the mail recently. Suspension hearing is still happening soon.

Answer

If your friend’s license is suspended after the hearing, DPS records will show his license is suspended and if he is caught driving while his license is suspended, he will be subject to an additional criminal charge. The fact he will have an actual driver’s license in his pocket will NOT keep his license from being suspended.
