Asked 3/5/2016 – Houston, TX

Hi everyone,

I recently got my record expunged, but I learned that this is only half the battle of getting myself fully cleared. The next step includes tackling the thousands of private background check companies that are not required by law to update their system, unless ordered to by the court.

I have a full-time offer hanging in the balance – what should I do to make sure I have the best chance of clearing my record from the thousands of private background companies that most likely still show me as a criminal? A list of thorough or detailed steps would greatly be appreciated.

Thank you!

Answer

Send a certified copy of the Order Granting the Expunction to the major private criminal background services. Unfortunately, there is not one place you can go to remove this matter from the entire internet. Potential employers are SUPPOSED to inform you if something is discovered on a background check and give you the opportunity to respond and hopefully clear up the matter. As a practical matter, you will have to deal with this issue as it comes up.
