Asked 3/12/2016 – Houston, TX

I was charged with a misdemeanor and got deferred adjudication probation for 9 months but the judge told me I can get out of it in 4 months if I fulfilled all the requirements. It’s been 3 months and I’m done with my community service hours and everything. I need a lawyer to file a motion for early termination. I don’t know how much it would cost in my case. I’m a student and can’t afford an expensive lawyer. How much should I expect?

Answer

If your probation is supervised, check with your probation officer to make sure the probation department will not have any objection to early termination. The attorney fees will be less if the matter is uncontested. Then call the lawyer who represented you on your original plea; that’s as good a starting place as any to inquire about fees. Again, there is no union scale that lawyers charge. Find one you feel comfortable with and you can afford.
