My Boyfriend Was Arrested For Capitol Murder For Something That Happened In March of 2013, It Is Now March 2016. But He Only Got Arrested On He Say She Say. No DNA Or Physical Evidence That Puts Him There. Can They Do That I Live In Texas!

Answer

I doubt severely that the State has NO evidence whatsoever against your boyfriend, that he was just walking down the street on his way to Bible Study when police threw him in a squad car and charged him with capital murder on a case he knew nothing about. His name came up somehow. Criminal cases were tried for a long time before DNA evidence was available, so such evidence is not required to pursue a case. Eyewitness testimony may be sufficient. For example, it you tell police that a person you know punched you and you want to pursue assault charges, the case would not be denied due to lack of DNA evidence. Talk to a local attorney IMMEDIATELY. Find out the evidence. If he is in custody, do NOT talk about the facts of the case over the phone. Jail phone conversations are monitored and recorded.
