Asked 7/8/2016 – Copperas Cove, TX
A search warrant was issued on my previous address for meth dealing, meth users ect all they found was a pipe and the current resident claimed it and went to jail. I was named in the warrant to arrest me for the accusation of criminal activity forthwith possession of methamphetamines. I spoke to a lawyer and he stated do not turn myself in based on what they found was claimed and they may not even pursue my arrest warrant. I feel i should get a lawyer turn myself in on a walk through to get the process going. Can you please tell me my options? It says an affidavit was signed by someone. I do not do drugs nor do i ever possess them but my previous roommate who was arrested does. The bills are still in my name only because she has bad credit. What should I do?
Answer
There is a difference between a search warrant and an arrest warrant. The fact a search warrant that has your name listed was executed does not mean you are to be arrested. If the search warrant, however, led to the issuance of a warrant for your arrest, you do need to retain an attorney. The warrant for your arrest will not magically go away. It will remain outstanding until you are arrested. Hire a local attorney, find out exactly what’s going on and deal with the matter.
