My wife and I are going thru a divorce. We were meeting with the principal at my sons school and my son pushed me, I pushed back and an officer there issued me a ticket AND took me to jail. I have a hearing on the class C misdemeanor, but I still can’t figure out why I was taken to jail for a class C. Is this going to cost a lot? it’s just jp court. I think wife and son are setting up for something.

Answer

Although jail time cannot be assessed as part of the punishment on a class c misdemeanor, an officer has the option of bringing an individual before a magistrate and having a bond set for all class c misdemeanors (except speeding), in the same way arrests are made for more serious offenses. Whether you are being set up is something you and your divorce attorney should discuss.
