I was arrested for theft at Target. I have never been in trouble with the law and this would be my first offense. They totaled everything up to $289.00 and said it is a class b misdemeanor. They made me sign a form in target saying I tried to take it. I was on the phone and rushed out not even thinking straight. Also I just recently had a bone Marrow transplant so I do not have money for a lawyer. Also I’m wondering will they tell me I will have to go to jail if so I’m worried about that because I’m still in treatment for my transplant?

Answer

A class b misdemeanor is punishable by a fine of up to $2,000, confinement in jail for up to 180 days, or a maximum probationary period of up to 24 months. You have the right to a trial, the right to force the State to prove the allegations against you beyond a reasonable doubt, the right to cross examine any witnesses against you, and the right to present witnesses on your behalf. If you are convicted of this offense, it will remain on your record forever. If you cannot afford an attorney, you can petition the Court to have an attorney appointed for you. Since this is a crime of moral turpitude, you definitely need legal representation, I suggest you contact attorneys in the area to discuss this matter; I know many do not charge for a consultation fee, Good luck.
