Asked 8/16/17 – Austin, TX

I hired a lawyer for my spouse he has felony charges and he is on probation, currently locked up. I recently called a bail bondsman and they said they can put in a request to reinstate his probation, is that true can the bondsman do that? If that is possible why hasn’t my spouse lawyer tried to reinstate my spouse probation?

Answer

Only the Court that granted probation can re-instate the probation. Are you sure the bondsman was talking about reinstating the actual probation or reinstating the bond posted on the probation violation? The process can be confusing, so schedule an appointment with your spouse’s attorney and have this discussion with her/him.
