Asked 7/30/2016 – Kerrville, TX

I was on deferred adjudication probation for burglary of motor vehicle class A misdemeanor but I violated by not finishing community service on time, I was lucky to get an exstention on my probation to finish my community service hours but I was going to be charged with my crime but I didn’t know if it was staying a class A misdemeanor or turned into a felony. so can my class A misdemeanor turn into a felony for that?

Answer

You case cannot be enhanced after you have been placed on probation. If you were placed on deferred adjudication probation for a class a misdemeanor, and you violated the probation, the punishment range is up to a $4,000 fine and confinement in jail for up to 1 year (or you could be continued on probation).
