Asked 8/18/2016 – Weatherford, TX
I had a warrant out for probation violation and was picked up because the county said they would like to extradite me. After sitting for two weeks they send a teletype to the jail stating, and I saw it, suspect is to be released and charges to be dropped/dismissed. I was released that day and later am told I still have an active warrant by a relative. I called said county and after being given 3 phone numbers I get to the county attorney’s office who says and I quote “I’m not sure” when I ask if the warrant is active. She calls the lady at the jail who sent the teletype and calls me back saying in fact all charges are being dropped and paperwork will be sent to me. Almost 3 weeks later still an active warrant and now I am not allowed through to this lady at the attorney’s office and no one remembers this ever happening. Help!!!
Answer
You have 2 separate issues: 1) Can a county that issued a warrant and placed a hold on an inmate in another county then release the hold? Yes, it fact it happened in your case. A warrant was confirmed, a hold was placed on you, and then you were released without being transferred or posting bond. 2) Does this release mean that the underlying case has been dismissed? No. Just because the county that issued the warrant did not want to make the effort to get you from another county has no bearing on the facts of the underlying charge. Check the records of the court where the probation was pending. The clerk of court can tell you if a warrant is still active.
