Asked 4/26/2016 – Houston, TX

I bailed out my brother and co-signed on his bail. He missed his court date, but I was able to bring him in and he was arrested. 2 years later a lawyer calls and says I’m being sued for $1000 in court fees. So far nothing is in writing.

Answer

You may be sued by the bond company if you were a co-signer on the bond, and the bond was forfeited due to your brother’s failure to appear in court as directed. You don’t have to pay any money yet, and a lot will depend on if and when your brother’s case is disposed of and how much money the bond company as to pay due to the bond forfeiture. Once you are served in any civil proceeding regarding the forfeiture, contact an attorney.
