Asked 2/11/2016 – Conroe, TX
I’m coming up to a year and a half of 3 years on felony deferred probation for robbery, in the beginning of probation I failed a UA and I sat in jail for 14 days. From the day I got out I have done everything by the book here in Montgomery county. So my question is do I have to hire a lawyer to file the motion to terminate or can I do it myself?
Answer
You have the right to represent yourself in any proceeding before the court. If you choose to represent yourself, you will be held to the same standard as an attorney in dealing with the prosecution and the court. If you feel comfortable in representing yourself, you may do so, but don’t expect any court personnel to tell you which form to file and what steps you need to take.
