Asked 4/9/2016 – Austin, TX

Texas Criminal Appellate Law – Must a Petition for Discretionary Review (PDR) proceed a habeas corpus appeal against a discharged sentence for which no appeal has ever been taken, especially mindful that habeas corpus appeals have Criminal Court of Appeals judicial opinion that state habeas corpus is the correct vehicle for post-discharge felony convictions (sentence discharged 6 years earlier with a judgement date 14 years earlier)? (That being said I can no longer find the references I refer to understand.)

Answer

You can file whatever you want. What are you trying to accomplish?
