Asked 7/15/2016 – Houston, TX

I was camping and the cop wrote everyone there a ticket for a MIP. The cop kept flashing the light in my boyfriend’s eyes and he kept asking nicely if he could stop. But it seemed like if he was doing it on purpose because he kept flashing on his face and only on him the entire time as. Until he asked my boyfriend to put out a campfire and caused my boyfriend to get a second degree burn on his foot because he blinded him while doing so. He then stopped flashing the light on him once he saw that he was hurt and started acting a little kinder. My boyfriend now cannot walk or go to work. What can we do about this?

Answer

The question you originally posed doesn’t have much to do with the fact situation you described. Can an MIP be removed from your record? Yes, if no conviction was entered on the case. What to do about the burns your boyfriend received? You can contact a personal injury attorney, but you would have to show some type of negligence on behalf of the officer or some denial of civil rights (what’s called a 1983 claim) in order to recover any damages. Invest in a call to a local attorney.
