Asked 1/27/2016 – Houston, TX

My 3 months probation ends in April over my dumb misstake of shoplifting under $50. I went before my court date & I talked to the judge & she basically said I would have gotten probation anyways bc it was my 1st offense. If I complete the probation successfully & get it dismissed, can i do anything about getting off my record or sealed or anything of that nature? Thanks

Answer

If you: 1) were granted deferred adjudication on a class c misdemeanor, and, 2) you successfully complete the probation and the case against you is dismissed, then, 3) you will be eligible for an expunction on the matter. It does not happen automatically, and you will have to file a petition with the court (usually not the same court where you went to before), so you may want to contact an attorney after your case is dismissed.
