Asked 8/27/2016 – College Station, TX

In the question above I know the answer would be no, BUT as a stipulation of my guilty plea I was placed on deferred adjudication, which I completed successfully with no issues. I’ve read that completing deferred adjudication successfully does not result in a conviction and thus “dismissed”, which would permit me to own a firearm. The only thing I’m unclear on is if the “family violence” stipulation would make it illegal for me to.

Answer

If there has been an affirmative finding against you in any legal proceeding, you can never possess a firearm. The deferred adjudication and subsequent dismissal means you have not been convicted of an offense, but the affirmative finding prohibits your possession of a firearm
