Asked 8/12/2016 – El Paso, TX

We have been together for 6 years he’s been on probation for two years and I barely got probation. We have been living together for 3 years. Neither of us have anywhere else to go. What can I do.? I live in Texas.

Answer

The first place to start is to review what your probation order states about the matter. Have either one of you been convicted? If so, there is generally a provision in a standard probation order about not associating with known felons. If you feel there is a problem, have your attorney approached the Judge who imposed your probation. Explain your living arrangements and see if this is permissible with the Court. Whatever you do, do NOT just try and hide the matter, then claim “There was nothing else we could do!” once probation finds out who you are living with. That would be a good way to end up in prison. Be proactive, and take the approach that you will do whatever it takes to successfully complete your probation.
