Asked 8/17/2016 – San Antonio, TX

I had a Class A misdemeanor (assault-bodily injury to family/ household member) dismissed 7 months ago, without receiving deferred adjudication or pretrial diversion. I was never convicted of the crime or put under community supervision, but received what I was informed was the most lenient punishment, which is the completion of an anger management course (that lasts a single day) either online or in person, and then providing the court with a certificate of completion so that they could dismiss the case. I did not have to pay a fine and there were no court costs. Rather, I simply completed the course online and my case was dismissed. I had also been diagnosed with bipolar disorder, was hospitalized for a month, and received treatment after being charged. was also falsely accused of a Class C misdemeanor (assault by contact) by a former “friend” who betrayed me and wanted to defame me when I was 17 years old, 2 years before the family violence case happened. This case was dismissed for insufficient evidence (since my “friend” basically lied about me confronting her inappropriately or ever touching her to get revenge and form a case against me) and I never had to show up for court.

Answer

You must contact the licensing board of the particular agency in question to determine what the qualifications and disqualifications are for that field of endeavor. For employment purposes, you may state on any job application that you have never been convicted of a crime. The fact that these cases were filed, however, will show up on a background check, so you should also strongly consider contacting a local attorney about filing partitions for expunctions on these matters
