Asked 5/18/2016 – Clarksville, TX

I have 4 drug charges and my first offer was 18 years second offer was 10years…my friend has the same identical charges he was offered 18 years first then 10years probation 2nd offer, another guy had way more drugs than me he was offered 40 years then he got 10years probation…can somebody tell me why things much harder my way…could my offer get better before a trial date?

Answer

Anything CAN happen, but I do not know the exact charges against you, the punishment range for each case and whether any enhancement provisions are applicable. Your attorney is the best person to know what your options are. Do NOT fall into the trap of believing that “I heard about this guy that was charged with five more cases and with 10 convictions, and he got probation” or whatever. You deal with your cases. Period. You don’t know the facts about anyone else’s situation, and anyone else’s case is irrelevant to your situation. You and your lawyer deal with the facts of YOUR case and decide if you want to accept the plea offer or have a trial.
