Asked 6/27/17 – San Antonio, TX

Was sentenced to 27 min of 13 for agg assault w/deadly weapon. First offense, no priors. Had a hired lawyer and didn’t bargain just put them on the spot to speak for themselves with out discussing what to say.

Answer

A Judge cannot grant probation on a case where a finding of a deadly weapon is made (See Texas Code of Criminal Procedure Article 42A.054 (b)(1)). I also do not know what you mean by “sentenced to 27 min of 13”. I would also need to know if the case was tried before the court, was there an agreed sentence or was there an open plea. Good luck.
