Okay so 18 year old and 15 year old have sex the parent goes to the cops and the investigator brings it to the grand jury can he legally say they’re going to send him to the Amy and can you tell why this is a case because one kid is in 8th grade because she failed but I don’t this case shouldn’t be a case can you just help me understand why it is a case

Answer

Enlisting in the Army will not prevent prosecution of a criminal case; in fact, if a criminal case is pending, the armed forces will not let you enlist. A criminal case can be filed against the 18 year old because it is an offense to have sexual contact with a person under 17 years of age (with some exceptions – See Texas Penal Code Section 21.11 – Indecency with a Child). Consent does not matter in determining whether these charges would be filed. Contact a local attorney soon.
