Asked 8/6/2016 – Dallas, TX

I’m being accused of jewelry theft cops had a search warrant for my house while I was gone they search and didn’t find anything so I’m wondering what’s next will I have an arrest warrant? Will I be sued? I have never been arrested before and I have no prior criminal record. This is a person I worked for years as a caregiver.

Answer

Just because a search warrant was issued for your home does not necessarily mean an arrest warrant will be issued for your arrest. The search warrant was issued to obtain evidence. You state none was found. If the police already have enough evidence against you to prepare an arrest affidavit, have it reviewed by a magistrate and that magistrate believes enough evidence exists, THEN an arrest warrant will issue. In any event, you are the subject of a criminal investigation, so you should start talking with local criminal defense attorneys.
