Asked 6/13/2016 – Victoria, TX

A friend served 18 months in state jail close to Dallas. Charge was theft $1,500 to 20k. He now has same charge here; case was supposed to be civil and somehow got turned into criminal out of a complaint. We didn’t even know he had a warrant until we decided to look online; he was even indicted without being present.

Answer

Whether your friend can receive probation in his new case depends on the specific facts of the case. It is not required that a defendant be present at a Grand Jury hearing. Contact a local attorney in the county where the warrant is pending.
