Asked 8/8/2016 – Austin, TX

Looked up someone who got arrested 2 days ago record online. It said 2 charged distribution or manufacture 1-4g. Today it was updated below to say disposition 8/7/16: no charges file. Does this mean no charges will be filed for the felony and he’s free to go?! Thank you!

Answer

No, the fact that an on-line record states “no charges filed:” does NOT mean criminal charges will never be filed. Depending on the exact offense, the State has several years from the date of the offense to file the charging instrument, an in drug cases, it will generally take several weeks for a case to be presented to a Grand Jury. The contraband will first be delivered to a crime lab for chemical analysis and the DA will wait for the results before proceeding with the case. Start talking with local attorneys.
