My spouse has been sentence 3 years for violation of probation, he gain charges in ft bend county which consist of organize crime theft, trespassing, theft. Online it shows that organize crime is suppose to be dismiss, the problem is, when they sentence him in Harris county for the violation, he hasn’t seen the judge in fort bend for those charges, what do we do cause his court day was today!!! Is he eligible to parole on the 3 year sentence for violation probation? Do he serve time then come back to ft. bend?

I want to make sure I have your husband’s situation correct. He is currently in the Harris County jail. He was on probation for a case from Harris County, and that probation has been revoked. He has been sentenced to 3 years in prison on the revocation. He also has new cases in Ft. Bend County. Those cases show a court date for April 15.
If the above is correct, Ft. Bend County will have an outstanding bench warrant for your husband. This will notify the Harris County Sheriff to transfer him to Ft. Bend once Harris County is finished with him. Once he is transferred, he can begin the process of resolving the cases that remain pending. He can be sentenced on the new cases anywhere within the punishment range provided by law (meaning he can be sentenced to more than 3 years on the new cases). You should contact an attorney in Ft.
