Asked 8/22/17 – Sealy, TX

If A citation was given for a paraphernalia charge with no drugs the rolling papers were on the car passenger seat how serious could this citation be how can it get dismissed because no drugs were found wasn’t even the driver?

Answer

Drug paraphernalia is a class c misdemeanor, punishable by a fine of up to $500. The fact you were not the driver of the vehicle will not cause automatic dismissal of any possession charge. If you seek dismissal of the charges, I suggest you contact a local attorney. Good luck.
