Asked 4/1/62016 – Mcallen, TX
I got arrested for failure to identify. I gave a false name to avoid getting arrested for a traffic warrant I had on record.
I’m going to court soon and I’m not even sure if I’m going to get a court appointed lawyer. I told I was but I’m not 100%.
My question is what is going to be my penalty if I’m found guilty
I know the punishments but what can I expect?
I have an arrest record.
Pi x 3
DWI = Case dismissed.
Honestly I really don’t want to go to jail. I don’t care about anything else I just don’t wanna go to jail.
Everybody is telling me I’m just going to get probation but I feel like they are just saying this to make me feel better.
Thank you.
Answer
The punishment range for a class a misdemeanor is confinement in jail for up to 1 year, up to a $4,000 fine or a maximum probationary period of up to 24 months. You have the right to a jury trial, the right to present witlessness on your own behalf, the right to cross examine any witnesses against you and the right to make the State prove the allegations against you beyond a reasonable doubt. If you are found not guilty, the case is dismissed, no conviction will be reported on your criminal record and you would be entitled to an expungmnent of all materials regarding this matter. If you are found guilty, you may be sentenced anywhere within the punishment range provided by law. No one in this forum, however, can tell you what is going to happen in your specific case. You are going to have to get an attorney, have him/her review the evidence the State has against you, then see what the plea bargain offer is.
