I’m 19 years old, and I got arrested in August for a Fake ID, and got charged with a Class A misdemeanor. I got out on a PR Bond. I immediately hired a lawyer. The lawyer told me to not worry about it, and I haven’t heard anything about the arrest or him, since August. A couple weeks after I was arrested I did notice I put the wrong mailing address, and I called them to change it. They said that I wasn’t in the system yet and they would change it immediately. I got pulled over around November for speeding (got a new vehicle and the speedometer was 10 mph off) and got off with a warning. I’m pretty sure I don’t have a warrant. Do you think my case got dropped? I’m not entirely sure what to do. I’m about to move off to a university and I don’t want this to come back and haunt me a year after my screw up.
Answer
The State has 2 years to file the charging instrument in a misdemeanor case before the statute of limitation expires. Accordingly, your case is not necessarily dropped. Stay in touch with your attorney and make sure that attorney and the court has your correct contact information. If the wait is making you nervous, your can call the court clerk once a month or so to check the status of your case. Good luck.
