Asked 3/1/2016 – San Marcos, TX

Im from Gonzales, TX. December, 2014 i recieved 1 yr probation for poss of marijauna (class B misd.) Three days later i did something stupid. I was broke and i desperatly wanted to get my daughter a christmas present so i shoplifted from Hobby Lobby located in Hays co. San Marcos,TX. Got caught, charged me with theft class B misd. Which should have been a class c misd. But to tip the scale over 50$ she put an extra piece of merchandise so id go to jail. She said it was open on a shelf… And assumed i opend it!! So i never showed up to court for the theft so over a year has passed (by the way, i didnt have my probation fees quite paid off so my p.o. gave me a 3 mo. extention) and now all the sudden after ive complied for a yr a 2 months, paid off my fees, he just issued me a motion to revoke because of the theft case i got 3 days after i got on probation… So i have a court date on the theft in Hays co march 1 which i plan on going and ill soon have a warrent for my aresst for the motion to revoke. What would be the best way to go about this? I want to fight the case or get it droped to a class C misd. That way i might can get my probation for the marijauna reinstated.

Answer

You have to retain an attorney in Hays County to represent you. I doubt seriously you will be able to walk into court, tell the DA to reduce or dismniss the charges and he/she just say, “OK”. Theft is a crime of moral turpitude, so make sure no final conviction is entered on that case.
