Hi I’m Bryhana. I was put on probation after doing time served for a misdemeanor theft case . My probation was originally for 6 months but it was extended due to my fee not being paid. So after it got extended 6 more months I’ve done everything I was told to do to be released. I am now 8 months pregnant and my probation officer keeps saying that I’m failing the urinalysis which I know is impossible for multiple reasons. I am up to date with my prenatal care and IM PREGNANT! Using drugs is a no no while I’m pregnant. So I went to see her for the month of February and I was arrested due to her violating me for the month of January. I need to know what I need to do about getting this handled and taking this to court because I’ve had problems with this officer since day one and I also want to sue for deformation of character and pain and suffering. When those officers cuffed me they told me I violated parole (which I’m not on…. Only on probation) and they couldn’t tell me what the violation was. As the cuffed me and pushed me in the back of the car I started having contractions that caused me to have to be sent to the emergency room. now I’m released but there is an active warrant!!!

Answer

You will have to retain an attorney. You will NOT just be able to talk with someone and have the motion to revoke withdrawn. You will have to obtain copies of the negative UA results to determine what you tested positive for. Take the results to your doctor and see if any medications you are taking would give false positive results. Your doctor should also have blood results from you over the past few months; obtain copies of those and see if any substances found in the court UA a present in the samples taken by your doctor.
