Asked 6/24/2016 – Abilene, TX

I was in a bind my insurance on my truck expired. Got pulled over and got a no insurance ticket. Proofing that ignorance is no excuse to the law, the failure to appear followed ten days later and twenty days after that I got pulled over in a car I just purchased not insured either. No insurance ticket number two, and expired registration, possession of marijuana no prior drug charges. Is there any chance of getting all this dismissed with other stipulations? And how come the arresting officer never read me my rights before or after jail.

Answer

It is possible to avoid convictions for the no insurance citations if the court where these citations are filed offers deferred disposition probation. Contact a local attorney to determine if that option is available in the court where your case is pending. The failure of law enforcement to read “Miranda Warnings” might cause any statement you make while in custody to be excluded as evidence at trial; if you made no such statements, the reading of such rights is irrelevant.
