Asked 1/15/2016 – Dallas, TX

I was on deferred adjudication for felony possession of a controlled substance under one gram. In 2013 I was released from probation and during my last meeting with my probation officer he informed me that my rights were restored and that it was legal for me to purchase and own a firearm. I called him recently to verify that this was in fact true and he told me exactly what he did in 2013.

Answer

If you want to read the statute, check out Texas Code of Criminal Procedure Article 42.12 regarding deferred adjudication probation. If you successfully completed the probation, your case was dismissed. Contact the court who granted the probation and you can obtain a copy of the dismissal If the case was dismissed, you should be able to obtain an order of non-disclosure to seal any record of this case from public view. Contact your attorney.
