Asked 3/26/2016 – Corpus Christi, TX

Me and my husband decided to leave our kids and go out for the night at a concert. I had about 2 1/2 mixed drinks and a beer. Did not expect to get so messed up, as I’ve drank way more than that for many years (I’m 28 years old) I had gotten lost from my friend and my husband. It’s very unclear but we’re thinking a guy stole my phone and could have drugged me. My friend saw him following me when she found me. When I saw my husband, I was very upset that I couldn’t find him and threw my drink…I then ran off, trying to get away from him and he grabbed my arm asking what was the matter? Cops saw and started choking him, saying he beat me. When I went to explain everything, they immediately handcuffed me and told me to shut the “f” up. These were the craziest cops I’ve ever witnessed in my life. They acted like we murdered someone. They somehow let my husband go, but took me in for PI. I had to stay in detention center for 4 hours. They wouldn’t let me wear a bra but I was allowed to wear boots? Couldn’t tell me what officer went with me to take my bra off. My $700 bracelet is missing and according to them, I was never wearing it. I feel as if I didn’t deserve this!

Answer

It is probably best that you retain an attorney. If there is a police video available, it can be obtained during the discovery process in the defense of your public intoxication case. If the police, however, were working as off duty security at the concert, they may not have been using body-cams; video may not be available until on duty officers arrived. The concert venue may have security cameras, but someone needs to find this out immediately and make sure any video is preserved.
