Asked 6/21/2016 – Huntsville, TX

I’m on probation for a misdemeanor class c and I have a new charge, failure to identify. This is my first offense.

Answer

If you are on probation and have a new charge, you have had more than one offense. Class c misdemeanors are punishable by fine only, so if the probation is revoked, you may have to pay additional fees and the offense may be converted to a conviction, Revocation of probation is totally discretionary with the Court, so what the Judge will do in your specific case is unknown. Talk with a local attorney. Bring the probation order in your first case and discuss the options on your new case and how it affects your probation.
