My husband has a warrant from Coles County Illinois. He got picked up in Texas for it and is right now in Guadalupe County jail in Texas. No one seems to know how long Texas is able to hold him for Illinois. I am getting information of maybe 20, 30 or maybe longer.
How long does Illinois have to pick him up. Nobody seems to know the answer. I really just like to know how long my husband has to wait or what we should do. We do have a lawyer in Illinois but he can’t not do anything until he is in Illinois. Since we are so far can someone please let me know where or who to call to get a number of days.
Answer
Did your husband waive or contest the extradition? It is impossible to say exactly how long he will be held (see Texas Code of Criminal Procedure Article 51.13 for the Uniform Extradition Act). The quickest way to move forward is to contact an attorney in the county in Illinois where the case is pending and see what can be done; depending on the offense, Illinois MAY not want to spend the money, time and effort to pick him up. Good luck.
