I use to live in a small town and so cops knew me and i knew them. They knew i didnt have my dl back then but hadnt pulled me over for awhile..The cop followed me that day after picking up my daughter from school..He followed me almost 2 miles.I knew he was behind me still. So as soon as i drove away from a stop sign he pulled me over.I know there suppose to tell you the reason why they pull you over but he didnt. He asked for my dl and insurance.I had ask him why he pulled me over and then again asked me to show him my dl and insurance.then i asked him well can u first tell me the reason why you pulled me over.He laughed and said so u dont have no dl..then he said i pulled u over because you were goin 33 on a 25..I said how was that after i jus had drove away from the stop sign and my car wasnt even on the 10 mph mark when u flashed the lights.I asked if i could see where he clocked me at and walked away and wrote a ticket…So after that i called it in and they said there was no ticket at that time..so i never bothered again..Moved out from that town a year after that.so now after 3 years not living there now my name is on a round up this year..Can they just now make it into a warra
Answer
Once you are issued a citation, the State has 2 years from the date of offense to file the charging instrument with the court (the complaint). Once that is done, the statute if limitations is tolled. You have the obligation to contact the court and enter a plea of guilty, not guilty or no contest. If you do not do so withing the time frame provided on your notice to appear ion court (the ticket the officer gave you), a warrant can be issued for your arrest. The ticket you were given and signed is just like a bond you would post to get out of jail on a more serious violation like DWI; if you let me out of jail, I will appear in court when I’m supposed to. If and when the warrant issues is up to the court. Call a local lawyer and you should be able to get some help.
