Asked 7/8/2016 – Fort Worth, TX

My daughter was charged with POSS CONT SUB 4-200G-PG1 Tarrant County Texas. She had a parole violation and her PO told her she would need to do 90-days at ISF. She has been under house arrest at the Tarrant County jail for 60-days “waiting for a bed” at ISF. From what I understand, none of this time counts and she can be held indefinitely. Any advice?

Answer

If you daughter is on parole, she can be held indefinitely until a bed opens up at the facility she is assigned to. It is true that the time she is waiting in jail for the bed to open up does not count as jail time credit towards her sentence. Her alternative is to tell her parole officer she just wants to finish her prison time in the TDC.
