Asked 3/26/2016 – Conroe, TX

I’m coming up on a year and a half of 3 years deferred, I’m just wanting a heads up of about how long the whole process usually takes, my charge is robbery out of the 9th district court, Judge Kelly Case.
I’m not sure if this makes any difference but 2016 is his last year on the bench. I would love to hear from anyone familiar with Montgomery county and how they work please and thank you.

Answer

If your probation officer and the District Attorney have no objection to early termination of your probation, it should not take long at all. Have your attorney talk with the DA in that court to see what that Judge’s procedures are regarding early termination. You speak with your PO and see if the probation deportment has any objection to the early release. Generally, once the motion for early discharge from probation is filed, the Judge will informally ask if there is any objections from the State. If there are none, an order is signed
