Asked 6/21/17 – Austin, TX

Husband was recently arrested for not reporting to his PO. This is his first time on parole and first mess up. He was only arrested for the warrant and did not receive a new charge. I’m not sure the difference in parole and mandatory supervision if there is any or if it matters but when he was released it was mandatory supervision, is this automatic return to prison?

Answer

There is no set time deadline I can give you regarding when your husband’s parole violation will be resolved. He must first be formally served with the motion to revoke, and then he will have the option to either contest the allegations and have a hearing on the revocation, or agree with the allegations in the motion to revoke. Once your husband has been served with the motion to revoke, contact a local attorney and get some advice as to how to proceed. Good luck.
