Asked 6/23/2016 – Montgomery, TX

My husband was arrest for family violence here in Texas found he had a warrant in Utah. The warrant I believe is violations of probation on a criminal mischief charged he waited out jail time and paid fines. Now they issued a warrant for violation of probation

Answer

There is no statutory deadline on how long any State has to pick up a prisoner. If your husband is in detention in Texas, he must finalize any cases he has here before Utah will be notified to come get him. After that, he will remain in jail until Utah gets him, or the Texas jail gets tired of holding him, notifies Utah: “If you don’t get this guy by X date, we are going to release him”, and X date passes. Get with a local attorney for specifics on your husband’s status.
