I was in a one person motorcycle wreck. Broke my shoulder and several ribs. The police officer checked my eyes and arrested me in the ambulance. After 5 hours in the ER they took my blood and I was admitted to the hospital. The officer said I will here back in 3 to 4 weeks it’s been 8 weeks and still haven’t heard about my results of the blood test. Should I turn myself in? Or wait ?
Answer
The State can file a DWI case against you before the blood test results are returned, or the District Attorney can wait on the results before filing the case. If the case against you has been filed and a warrant exists, you should contact a local attorney about posting a bond and proceeding on your case. If the case hasn’t been filed, there is nothing to turn yourself in for. I have had cases where it has taken 11 months for the blood test results to return, so there is no telling how long the process in your case will take.
