Asked 7/30/2016 – Gonzales, TX

I was arrested for under a gram last October. The officer pulled me over because my “license plate light was too dim”. In my car I had a keychain hanging that read “San Francisco California” and had a little pot leaf. The cop and I were making small talk because he graduated from the college I attend. Once the officer saw the keychain he asked me to step out of the car, of course I complied. He asked me if I smoked pot, to which I said yes but explained I hadn’t smoked any before driving; he then asked if I had any on me. I explained I had less than a gram in a glass jar in a laptop case in the back seat of my car. I gave him consent to search. He arrested me and on July 11th of 2016, I took a plea deal for a year of differed adjudication. I graduated high school in the top 8% and I am currently pursuing a degree in computer science. I have a 3.5 gpa, last semester got dean’s list w/ a 4.0 and I start on the lacrosse team that won the championship my freshman year and lost the championship game this year. I am a server at a Cracker Barrel and pay for my own college. I started smoking when I lost my mom, and I’ve been ok. But this is making me depressed, my life/future are ruined…

Answer

You may request early termination from probation after completion of one-third of your sentence if you have paid all costs, fines and fees, as well as completed all other terms and conditions (such as any classes, etc.). See Texas Code of Criminal Procedure Section 42A.701. Talk with the attorney who represented you on your original plea.
