I have a Class B misdemeanor for Possession Of Marijuana. My attorney did not submit my P.T.D. Application in time (according to hildalgo county). I am a perfect candidate for the program. I was arrested my senior year in high school when I was 17 got out of county jail with a PR bond, and graduated high school I’m now 18 and a sophomore college. I want to work in the educational system. I don’t use drugs and clean as a whistle. I appeared every arrangement hearing when necessary.

Answer

You have no statutory right to enroll in a pre-trial diversion program. If you fail to meet any of the entry requirements, even through no fault of your own, your request can be denied. Your attorney may request the State to make an exception in your case, but you have no remedy to force your way into the program
