Asked 6/20/2016 – Carthage, TX

I got a case for having a knife which I turned in myself to the law. I got the knife because I got jumped by some gang members and was scared for my life because they threatened my life. The law wouldn’t help me. They transferred me to another prison and I was there almost 2 years and the previous prison indicted me for it and I’m going to court. If I get more time will I have to be in there longer than I supposed to. I have a 12 year sentence which I have served 4 1/2 years of it for aggravated assault w/ deadly weapon.

Answer

If you are found guilty of a new offense commuted while you are in prison, additional time will be added to your prison sentence, the 4 and 1/2 you served will NOT count as time on the new case.
