You may ask anything you want. It is within the discretion of the District Attorney to reduce the charge from a felony to a misdemeanor. If you are found guilty of a misdemeanor and sentenced to jail, you would serve jail time in the county jail. If you are found guilty of a felony and sentenced to jail, you would serve the time in the department of corrections (prison). This can be negotiated during the plea bargain process.
